ATIS Relay Terms of Use

1. Agreement to These Terms

These Terms of Use and End User License Agreement (the "Terms") are a binding contract between you and Torrey Systems, LLC, doing business as ATIS Relay ("ATIS Relay," "we," "us," or "our"). They govern your use of atisrelay.com and its subdomains (the "Website"), the ATIS Relay mobile apps (each, an "App"), the ATIS Relay text message service, the ATIS Relay APIs, and any related services we provide (together, the "Service").

By creating an account, installing an App, sending a text to our number, or otherwise using the Service, you agree to these Terms, including the warranty disclaimers and limitation of liability in Sections 23 and 24. If you use the Service on behalf of a company or organization, you represent that you are authorized to bind it to these Terms, and "you" includes that organization. If you do not agree, do not use the Service.

2. Summary of Key Terms

Without limiting the rest of these Terms, you acknowledge that:

1. The Service is licensed, not sold, and you may use it only as these Terms allow.
2. ATIS Relay content is supplemental information. Transcripts are produced by automated speech recognition and may be wrong, incomplete, or out of date. Always confirm current information through official sources (Section 22).
3. Paid subscriptions renew automatically until you cancel (Section 7).
4. Your mobile carrier's message and data rates may apply.
5. Your personal information is handled under our Privacy Policy.
6. The Service is provided "as is," and our liability is limited (Sections 23 and 24).
7. Disputes are governed by California law and heard in San Diego County courts, after first trying to resolve them informally (Sections 26 and 27).
8. If you use an App on an iOS device, Section 33 (Notice Regarding Apple) applies.

3. The Service

ATIS Relay provides aviation weather and airport information, including:

• Transcripts and audio of Automatic Terminal Information Service (ATIS) broadcasts, collected from FAA digital ATIS data, airport telephone lines, and receiver stations operated by community members ("Station Hosts").
• Automated weather observations (ASOS and AWOS).
• Access through the Website, the Apps, text messages, and APIs.

Coverage varies by airport and may change at any time. We do not guarantee that any airport, station, or data source will be available.

4. Eligibility

You must be at least 18 years old and legally able to enter into this contract. You may not use the Service if we have previously suspended or removed you from it. We may refuse or end access to the Service for anyone, for any lawful reason.

5. License and Restrictions

License. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to: (a) install and use the Apps on devices you own or control; (b) use the Website and text message service; and (c) use the APIs as described in our API documentation. This license is for your own use, or for the organization you are authorized to act for.

Restrictions. You may not:

• copy, modify, distribute, sell, rent, lease, lend, or sublicense the Service or its content, except as these Terms or a separate written agreement with us allow;
• decompile, reverse engineer, disassemble, or try to derive the source code of the Service, except where the law prohibits this restriction;
• disable or circumvent any security, rate-limiting, or access control feature;
• scrape, bulk download, or systematically collect data from the Service, except through the APIs within their documented limits;
• share your login credentials, or let anyone else use your account or subscription.

All rights not expressly granted to you are reserved by ATIS Relay and its licensors. These Terms also govern any updates to the Service, unless an update comes with separate terms.

6. Accounts

Some features require an account. You agree to give accurate information and keep it current. You are responsible for keeping your password confidential and for all activity under your account. If you believe your account has been compromised, contact us right away at the address in Section 34.

7. Subscriptions, Fees, and Automatic Renewal

Fees. Some features require a paid subscription. Prices, billing period, and what is included are shown before you buy. All fees are in U.S. dollars and do not include taxes, which you are responsible for where they apply.

Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current price, and your payment method is charged, until you cancel. By subscribing, you authorize these recurring charges.

Free trials. If you start a free trial, your paid subscription begins and you are charged when the trial ends, unless you cancel before then.

Price changes. We may change prices. We will give you advance notice of any price increase that affects your subscription, and the new price applies starting with your next billing period after the notice. If you don't agree, you can cancel before the new price takes effect.

Payment. Website subscriptions are processed by our payment provider (currently Stripe). App subscriptions purchased through the Apple App Store are billed by Apple under Apple's terms.

8. Cancellation and Refunds

How to cancel. You can cancel anytime. For subscriptions bought on the Website, cancel from your account page. For subscriptions bought through the App Store, cancel in your Apple ID subscription settings. Cancellation takes effect at the end of the current billing period, and you keep access until then.

Refunds. Except where required by law, fees are non-refundable and we do not provide refunds or credits for partial billing periods. We may grant refunds or credits at our discretion. Refunds for App Store purchases are handled by Apple under its policies.

9. Text Message Service

You can request airport information by texting an airport identifier to our number, 866-671-9172. Each phone number receives a limited number of free requests, as shown on the Website. Subscribers get unlimited requests, subject to Section 15.

• We send messages only in reply to your requests, and messages may be sent in more than one part.
• Message and data rates may apply. Your carrier's terms and fees are your responsibility.
• Reply STOP to opt out at any time. Reply HELP for help, or contact us at the address in Section 34.
• Carriers are not liable for delayed or undelivered messages.
• Text message delivery depends on carriers and networks outside our control. Do not rely on it for time-critical information.

10. Promotions, Credits, and Referral Program

We may offer promotions, free trials, credits, or a referral program. Each is subject to the terms we publish for it, including our Referral Program Terms. Unless those terms say otherwise, promotional credits and rewards have no cash value, are not transferable, cannot be redeemed for cash, and may be applied only to ATIS Relay subscription fees.

11. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which is part of these Terms. In summary:

• We collect technical information about your devices and use of the Service to provide support, updates, and improvements, and may use de-identified or aggregated data for analytics.
• Some features use your device location, with your permission.
• We use your email address for account and support messages. With your consent, we may also send news about ATIS Relay and aviation, and you can opt out anytime.
• We use your phone number to reply to your text requests, and not for marketing texts.

12. User Content

Your content. Some features let you submit content, such as audio and transcripts from a receiver station, feedback, reports, or other material ("User Content"). You keep any ownership rights you have in it.

License to us. By submitting User Content, you grant ATIS Relay a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable license to use, host, store, reproduce, modify, transcribe, create derivative works from, distribute, publish, and display it, in any media, to operate, improve, and promote the Service. This includes using it to train and improve our speech recognition and other models.

Your promises. You represent that you have the rights needed to grant this license, and that your User Content does not violate any law or anyone's rights. We may remove any User Content at any time. We do not endorse User Content and are not responsible for it.

13. Station Hosts

If you operate a receiver station that sends audio or data to ATIS Relay, these Terms apply to that activity, along with any host guidelines we publish.

• Stations must be receive-only. You may not transmit on any aviation frequency.
• You are responsible for your equipment, its installation, and having permission to install it where you do. You are also responsible for following applicable laws and property rules.
• Audio and transcripts from your station are User Content under Section 12.
• Hosting is voluntary. You are not our employee, contractor, or agent, and you are not entitled to payment unless we agree otherwise in writing.
• We may stop accepting data from any station at any time.

14. APIs

Use of the APIs is subject to our API documentation, including any rate limits and attribution requirements. Unless you have a separate written agreement with us, you may not resell, redistribute, or sublicense data from the APIs, or use it to build a competing service. We may change, limit, or suspend API access at any time.

15. Prohibited Conduct

You agree not to:

1. use the Service for any illegal purpose, or in a way that causes us to violate any law;
2. infringe or violate anyone's intellectual property, privacy, or other rights;
3. submit content that is unlawful, false, misleading, defamatory, harassing, threatening, or otherwise objectionable;
4. upload malware, or interfere with or disrupt the Service, its servers, or networks;
5. make excessive or automated requests, including by text message, beyond normal personal use, or use the Service in a way that imposes an unreasonable load on it;
6. send unsolicited messages or advertising to other users;
7. impersonate any person, misrepresent your affiliation, or create accounts by automated or fraudulent means;
8. sell or transfer your access to the Service; or
9. attempt or help anyone else do any of the above.

16. Third-Party Services and Data

The Service relies on and may link to third-party data, software, and services, including FAA data feeds, airport telephone systems, Station Hosts, mobile carriers, payment processors, and app stores ("Third-Party Services"). We do not control Third-Party Services and are not responsible for their content, accuracy, availability, or terms. Your use of them is at your own risk and may be subject to their own terms and fees. Portions of the Service include third-party software licensed under separate terms, which govern that software.

17. Ownership

ATIS Relay and its licensors own all rights in the Service, including its software, design, compilations, transcripts, data, and the ATIS Relay name and logo. Except for the license in Section 5, nothing in these Terms gives you any rights in the Service. If you use the Service on behalf of an organization, we may identify that organization as a customer in our marketing unless you ask us not to.

18. Copyright Complaints

We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512). Send notices to support@flyownnav.com. A notice must include:

1. your physical or electronic signature, as the owner or a person authorized to act for the owner;
2. a description of the copyrighted work you claim is infringed;
3. a description of the material you claim is infringing and where it is on the Service;
4. your address, telephone number, and email address;
5. a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and
6. a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner.

We will terminate the accounts of repeat infringers in appropriate circumstances.

19. Termination and Changes to the Service

These Terms apply until terminated. You may stop using the Service and close your account at any time by contacting us. We may suspend or terminate your access at any time if you violate these Terms, if required by law, or if we discontinue the Service. On termination, your license ends and you must stop using the Service. You remain responsible for any fees incurred before termination. If we terminate your paid subscription for reasons other than your violation of these Terms, we will refund the unused portion of any prepaid fees.

We may change, suspend, or discontinue any part of the Service, including coverage of particular airports or stations, at any time.

20. Additional Terms

Some features are subject to additional terms we post on or link from the Service, such as our Referral Program Terms, host guidelines, and API documentation ("Additional Terms"). Additional Terms are part of these Terms. If they conflict with these Terms on their subject, the Additional Terms control.

21. Feedback

If you send us suggestions or feedback, you grant us an unrestricted, perpetual, irrevocable, royalty-free right to use it for any purpose, without obligation to you.

22. Aviation Safety Disclaimer

ATIS Relay is a supplemental source of information. It is not an official source and is not approved by the FAA for operational use.

• Transcripts are created by automated speech recognition from radio and telephone audio. They may contain errors, omissions, or misheard words, including in runway assignments, altimeter settings, winds, and NOTAMs.
• Information may be delayed, out of date, or unavailable. Coverage, timestamps, and information codes may be incorrect.
• Always obtain the current ATIS, weather, NOTAMs, and other flight information from official sources, including on frequency, before and during flight.
• The pilot in command remains solely responsible for the safe operation of the aircraft and for obtaining all information required for flight.

Do not use the Service as your sole or primary source of information for any flight, air traffic control, dispatch, or other safety-critical purpose.

23. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ATIS RELAY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE OR ANY CONTENT WILL BE ACCURATE, COMPLETE, TIMELY, UNINTERRUPTED, SECURE, OR ERROR-FREE. YOU USE THE SERVICE AT YOUR OWN RISK. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

24. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

(A) ATIS RELAY, ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SUPPLIERS (THE "ATIS RELAY PARTIES") WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(B) THE TOTAL LIABILITY OF THE ATIS RELAY PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (1) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (2) $50.

These limits apply even if a remedy fails of its essential purpose, and they are an essential part of the bargain between you and us. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

25. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless the ATIS Relay Parties from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) your violation of these Terms or any law; (b) your User Content or receiver station; or (c) your misuse of the Service. We may take control of the defense of any such claim at your expense, and you will cooperate with us.

26. Informal Dispute Resolution

Informal resolution first. Before filing a lawsuit, you and we agree to try to resolve any dispute informally. Send a written notice describing the dispute and the relief you want to support@flyownnav.com (or we will send one to your account email). If the dispute is not resolved within 60 days after the notice is received, either party may bring a claim as provided in Section 27.

27. Governing Law and Venue

These Terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any lawsuit arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in San Diego County, California, and you and we consent to personal jurisdiction there. Either party may instead bring an individual claim in small claims court if it qualifies.

28. Export Control

You will comply with all applicable U.S. export control and sanctions laws. You represent that you are not located in a country subject to a U.S. embargo, and are not on any U.S. government list of prohibited or restricted parties.

29. Government End Users

The Apps and related documentation are "Commercial Items," consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation," as defined in 48 C.F.R. § 2.101. They are licensed to U.S. government end users only as Commercial Items, and only with the rights granted to all other users under these Terms, consistent with 48 C.F.R. § 12.212 and § 227.7202.

30. Electronic Communications

You agree to receive notices, disclosures, and other communications from us electronically, including by email, text reply, or notice on the Service. Electronic communications satisfy any legal requirement that a communication be in writing.

31. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms with a new "Last revised" date. For material changes, we will give you reasonable advance notice, such as by email or a notice in the Service, before they take effect. Changes apply going forward and do not apply to disputes that arose before the change. If you keep using the Service after changes take effect, you accept the updated Terms. If you don't agree, stop using the Service and cancel any subscription.

32. General

These Terms, together with the Privacy Policy and any Additional Terms, are the entire agreement between you and ATIS Relay about the Service, and replace any prior agreements on that subject. You may not assign these Terms without our written consent. We may assign them, including in connection with a merger, acquisition, or sale of assets. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. Section headings are for convenience only. If these Terms are translated, the English version controls. Nothing in these Terms limits any rights you have that cannot be waived by law. Sections that by their nature should survive termination will survive, including Sections 5 (Restrictions), 7, 10, 12, and 16 through 34.

33. Notice Regarding Apple

If you use an App on an Apple device, this section applies:

1. These Terms are between you and ATIS Relay only, not Apple. Apple is not responsible for the App or its content.
2. Apple has no obligation to provide maintenance or support for the App.
3. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the App's purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
4. Apple is not responsible for any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to meet any legal or regulatory requirement, and claims under consumer protection or similar laws.
5. Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the App or your use of it infringes intellectual property rights.
6. You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and are not on any U.S. government list of prohibited or restricted parties.
7. You must comply with applicable third-party terms when using the App.
8. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
